In spite of a chain of rulings from the Supreme Court of the US, the lawyers are advertising about their services, the issue of Lawyer Advertising remains a subject of hot debate. Those who favor Attorney advertising are of the opinion that the advertisements provides the customers with ample information regarding their rights and it’s so very convenient to find an Attorney for them during times of necessity. Those who oppose attorney advertising states that it’s a disgrace to the profession because the lawyers are like a salable commodity and moreover it will have an impression that, the Attorneys’ are only looking forward to financial gains. The popularity of the internet has taken lawyer advertising to a new magnitude, which paved way to more questions regarding the needs to check the rise of advertisements.
The opponents of Lawyer advertising are more concerned about the preservation of law as a career and as members of the profession, lawyers have taken an oath that they will safe guard the public interest and the public fear that the honesty is at stake as a result of lawyer advertising. In the history of US, Lawyers always were guardians of civil rights and democracy and the opponents of attorney advertising claims that by advertising the historic role of lawyers will have an adverse impact and this will bring irreparable damage to the profession .The Supreme Court and the State Bar Association has set forward some mode of conduct for the Lawyers and opponents are of the opinion that the parameter of advertising comes within the jurisdiction of these institutions. The Lawyers criticize the regulation stating that the regulation questions their freedom of expression, but the US Supreme Court has given powers to the States to monitor the Lawyer profession.
The opponents of lawyer or law frim marketing complain that, with all the existing restrictions many Attorneys harm the profession by advertising in the television and radio which creates a bad impression among the public, that the lawyers are chasing ambulances for a prey. The opponents feel that, if the restrictions are relaxed the Lawyers will go all out to grab business using all their might. And the discontent of the public on the legal system will shot up considerably. Opponents also feels that the unethical competation among Lawyers to grab business will cast a dark shadow on the profession, the lawful profession should focus more on public service than becoming money making machines. The opponents argue that Lawyer advertising gives a very wrong picture of legal services, stating that the ads makes things so very simple and the consumer will not have a chance to analyze the complex procedures of law. Opponents also points out that the exorbitant expenditure incurred on advertising will be passed on to the clients to certain extend and the cost incurred on advertising will not leave the lawyer with much enthusiasm in the procedures. The countless clients grabbed by the Lawyer by means of advertising will leave the them with very little time for a client, resulting in an improper analysis of the case.
Proponents of lawyer advertising argue that advertisement is not a disgrace to the profession, but it is purely democratic because advertising breaks down the concept that lawyers are far more superior being among the working community.
